WHEREAS
The General Terms of Sale are defined according to the terms and conditions governing the sale of SOTHYS brand cosmetic products by agreement between the parties involved—firstly, the Customer, and secondly, the Seller/Retailer.
The relationship between the Parties is governed solely by the Terms of Purchase in force at the time the Customer places an order.
The Seller may change these Terms of Sale at any time; changes take effect immediately upon being posted on the website www.sothys.vn.
The Customer confirms that they have read the Terms of Purchase carefully and fully accept them by ticking the relevant box when confirming each order. No order may be fulfilled without such acceptance.
Article 1: Customer
Under these Terms of Purchase, a customer who is permitted to use the Website is any individual aged 18 or over, acting as a consumer (i.e., not acting as an agent or retailer) who places an order for SOTHYS brand cosmetic products on the Website. By ticking the relevant box, the Customer fully matches the above definition and has full legal capacity to make a valid purchase.
Article 2: Verification
To ensure transaction security, prevent fraud involving online payment methods and/or verify the Customer’s quality and capacity, the Seller may verify the reliability of information entered when registering an order and may request one or more supporting documents from the Customer.
Furthermore, the sale of SOTHYS brand cosmetic products on the Website is reserved solely for consumers—individuals not purchasing for resale.
The Seller may cancel or refuse any order from a customer who does not comply with Article 1, lacks legal capacity to contract, and/or has an outstanding dispute relating to a prior order.
Similarly, the Seller may cancel or refuse any order that clearly does not correspond to normal consumption and personal use by a consumer—particularly any excessive quantity for an individual given the characteristics of SOTHYS brand cosmetic products—and/or any unusually repeated online order placed by the same person or by several persons using the same access credentials and the same or very similar addresses.
Article 3: SOTHYS Products and Prices
3.1 Characteristics and Availability of SOTHYS Brand Cosmetic Products
SOTHYS brand cosmetic products are subject to these General Terms of Sale as presented by the Seller on the Website and may be modified at any time.
SOTHYS brand cosmetic products sold on the Website comply with applicable laws of Vietnam.
Products are offered for sale and delivery only within the limits of available stock at the time the order is confirmed. If a product becomes unavailable after an order is placed, the Seller will inform the Customer as soon as possible. The order will be cancelled and any amounts paid (if any) will be refunded by the Seller within 30 days from the Customer’s payment date.
3.2 Prices
Prices of SOTHYS brand cosmetic products on the Website are displayed in Vietnamese dong (VND), inclusive of value-added tax (VAT), and shown on the Website when the Customer places an order.
The VAT rate applicable on the invoice date applies; any change in the VAT rate will automatically apply to the indicated prices. The VAT rate actually paid by the Customer is the VAT rate on the invoice date.
Prices do not include delivery/shipping fees or other charges (if any), which will be clearly displayed before order completion.
Promotional policies are valid only during the period of validity specified on the Website.
Article 4: Order Intake
1. Sign In or Guest Checkout
Customers may place an order without signing into an account. For easier order tracking and storage of order history, customers may register an account by completing all required fields in the account creation form (required fields are marked with an asterisk *).
After submitting the form, the customer will receive an email confirming account registration. The account is activated upon confirmation, and the customer can log in using the registered email and password.
If an account already exists, the customer simply logs in with their credentials to complete transactions.
2. Ordering Process
Step 1: Select products
Choose the desired product by clicking “Add to cart” on the product information page. The cart can be accessed and adjusted at any time by clicking the cart icon on the website.
Step 2: Verify and confirm the delivery address
On the cart page, confirm the delivery address by filling in all required information or editing existing details. Customers can also view estimated delivery fees (if applicable).
Step 3: Select a Spa / Salon Partner
Customers must select a unit (Spa / Salon Partner, etc.) to complete the order. If you do not have a preferred spa/salon, select “Order now – automatic selection.”
Step 4: Review the order contents
Review all order details, including product name, quantity, and total cost (inclusive of taxes and delivery fees, if any). At this step, the order can still be adjusted before payment.
Step 5: Agree to the Terms of Purchase
Tick the confirmation box indicating agreement with the General Terms of Sale before proceeding to payment.
Step 6: Choose the payment method
Select a payment method via the Paymentwall gateway—domestic cards, bank transfer, supported e-wallets (e.g., 9Pay)—or cash on delivery (COD).
Step 7: Confirm and pay
Click “Place order and pay” to validate and complete the order. The system will redirect to the corresponding payment gateway.
Step 8: Receive order confirmation email
Immediately after completing the order, an email confirmation will be sent, including: (i) the list of products; (ii) total amount payable; and (iii) the purchase invoice.
Step 9: Delivery and documents
Your order will be processed and shipped to the registered delivery address, together with the delivery slip. Standard delivery time is 3–5 working days.
Article 5: Payment of Orders
5.1 Payment Terms
· Payments for purchases made on the Website must be in Vietnamese dong (VND).
· Customers may pay via the Paymentwall gateway using domestic cards, bank transfer, supported e-wallets (e.g., 9Pay), or pay cash on delivery (COD).
Article 6: Delivery
6.1 Delivery Terms
SOTHYS products are delivered directly to the customer by the Seller or shipped by postal/courier services throughout Vietnam to the address specified by the customer during checkout—either to a home address or a pick-up point.
Customers must check the completeness and accuracy of delivery address information provided to the Seller. The Seller is not responsible for any errors in the information and consequences such as delivery delays and/or inability to deliver.
Delivery time: 3–5 working days.
Notes
· Order confirmation: All orders are automatically confirmed by email when the order is successfully placed on sothys.vn.
· An order will be automatically cancelled if the courier cannot reach the Customer at the time of delivery.
· All orders are fulfilled by our shipping partners.
· If the parcel shows signs of tearing, dents, wetness, or a broken seal, the customer has the right to refuse the package at delivery.
· If the parcel is delivered to a mailbox, neighbor, or security guard, the customer has the right to return the parcel to the post office/courier no later than the next working day if there are signs of external damage.
After receiving and opening the package:
· If the contents are wrong, missing, or damaged inside, the customer must send a return/exchange request by email within 03 days from the receipt date, including photos/videos as evidence.
· Customers who prepaid via Paymentwall may exchange for the same product or another SOTHYS product of equal value (subject to product availability).
· Customers who pay Cash on Delivery may exchange products according to the Seller’s return/exchange procedure.
Additional Notes
· Returned products must be in the original packaging and in the same condition as received.
· If the error arises from the Seller’s order preparation, the Seller will bear all exchange/return costs.
· For deliveries requested outside a carrier’s service area or outside working hours, any additional costs are borne by the customer.
6.2 Shipping Fees
Shipping fees are clearly displayed before the customer completes the order and are included in the total payable amount. The fee varies according to the customer’s chosen delivery method and delivery address.
If the customer has entered a delivery address, the shipping fee is displayed during the ordering process, in the cart, when confirming the cart, and in the final order confirmation.
Shipping fee tiers:
· Orders under VND 1,000,000: Shipping fee VND 30,000 per order.
· Orders from VND 1,000,000: Free shipping.
6.3 Tracking Delivery Progress
Customers can track delivery progress via system emails or contact Customer Service via phone or email for any questions related to their orders.
Article 7: Returns and Refunds
Customers may exchange and/or return products in the following cases:
· Products with manufacturer defects;
· Products damaged during transport;
· Products received that are clearly different from the Seller’s description in the product page;
· In case of an allergic reaction to the product: the customer must provide a certificate from a dermatologist specifying ingredients that fail to meet Vietnam’s drug–cosmetic safety regulations as issued by the Drug Administration of Vietnam, Ministry of Health.
The Seller does not support returns/exchanges in the following cases:
· Customer dislike / change of mind;
· Products already used;
· Free gift items.
Conditions for Returns/Exchanges
· Applies only to SOTHYS products purchased on the website Sothys.vn. The customer must retain the sales invoice and/or order confirmation.
· Time limit: within 03 days from the date the customer receives the product.
· For manufacturer defects: Product seals must be intact; packaging must be complete.
· For ‘not as described’: Product must be 100% new, with intact seals and complete packaging.
How to Exchange/Return
· Step 1: If you want to exchange/return, please notify Customer Service within 03 days from the time of receipt. After receiving your request, Customer Service will respond within 24 working hours.
· Step 2: Within 05 working days from receiving the confirmation from Customer Service, please send the product for exchange/return (together with: sales invoice, VAT invoice, included accessories or promotional gifts (if any)) to the Return Address: Recipient: Sothys Vietnam – Tel: 0987 397 667 – Address: Units 201–214, 2nd Floor, Lot 017 HH2, Tay Ho Tay New Urban Area, Nghia Do Ward, Hanoi City (Units 201–214, West Tower, National Defense Academy Apartment, Nghia Do Ward, Hanoi City). Keep proof of having sent back the parcel. If the product is returned outside the valid period, we regret we cannot process it.
· For exchanges/returns due to the Seller’s fault, the Seller will cover the shipping fee for the customer.
Step 3: Upon receipt, the Seller will inspect whether the product meets the exchange/return conditions. The Seller will process the exchange/return within 05 working days from the date of receipt.
Article 8: Liability
The Seller shall be fully or partially relieved of liability in cases of non-performance or poor performance of the sales contract caused by the customer, by the unforeseeable and unavoidable act of a third party to the contract, or in the event of force majeure.
The website is accessible 24/7 except during interruptions—scheduled or otherwise—for maintenance or in cases of force majeure. The Seller shall not be liable for any damage of any nature resulting from unavailability of the website; such interruptions do not give rise to compensation.
The Seller disclaims any liability for errors or damage arising from fraudulent intrusion by a third party that results in alteration of information on the Website, as well as any direct or consequential damage, regardless of cause, origin, nature, or consequences.
Article 9: Force Majeure
Neither party shall be liable for total or partial non-performance of its obligations under these General Terms of Sale if such non-performance results from a force majeure event.
Beyond events meeting criteria set by the Supreme People’s Court and by law, force majeure includes numerous events, not limited to epidemics accompanied by public health measures that prevent performance of obligations under these General Terms of Sale and cannot be remedied despite efforts by the affected party.
The party invoking force majeure must notify the other party within 05 working days from the occurrence of the event. The parties agree to consult each other as soon as possible to determine how to perform the order during the force majeure period. After one month of interruption due to force majeure, the Seller may cancel the order and will refund the customer if necessary.
Article 10: Warranty
SOTHYS products benefit from legal guarantees. The Seller complies with the Law on Protection of Consumer Rights as well as legal guarantees against product defects as stipulated in Articles 22 and 23 of the Law on Protection of Consumer Rights.
The Seller is obligated to deliver goods that conform to the order placed by the Customer and to remedy defects present upon delivery.
Goods are considered “conforming” when:
· They are suitable for the usual purposes expected for goods of the same type; and, where applicable:
· They match the description provided by the Seller or possess the qualities of a sample presented to the buyer;
· They have the characteristics that the buyer can reasonably expect, based on public statements from the Seller or their representatives (e.g., in advertising or on product labels).
Article 11: Privacy and Personal Data
As part of the customer’s user experience on the Website, the Seller may collect personal data relating to the customer. For more information, please refer to the Personal Data Policy.
Article 12: Evidence – Cookies
To enhance the usability and functionality of the Website and help the Seller provide better information and services, the Seller may collect data related to the Customer’s use of the Website via cookies. For more information, please refer to the Personal Data Policy.

Article 14: Mediation / Dispute Resolution
For any issues related to an order, the Customer should contact Customer Service (contact details at the beginning of these Terms of Purchase).
If the issue persists without agreement and the parties cannot resolve it through negotiation, the dispute will be brought before a competent court for resolution. The court’s decision is final and binding on the parties. All costs incurred will be borne by the losing party.
Article 15: Invalidity of a Clause
If one or more provisions of these Terms of Purchaseare deemed invalid or unenforceable for any reason, such invalidity or unenforceability shall not affect the other provisions of these Terms.
The Seller will replace the provision(s) in question with one or more valid and enforceable provisions in compliance with the law.
Article 16: Governing Law and Language – Competent Courts
These General Terms of Sale and any sales contract arising from transactions on this Website are governed by the laws of Vietnam.
In the event of a dispute, please first contact Customer Service to discuss, negotiate, and resolve the matter in the spirit of cooperation, transparency, and mutual benefit.
If the parties cannot reach an agreement through negotiation, the dispute will be submitted to the competent courts of Vietnam for resolution. The court’s decision is final and binding on the parties. All litigation costs shall be borne by the losing party.
The applicable language for the sales contract and for any procedures or disputes related thereto is Vietnamese.
